Agreement to Terms

By accessing or using the Services provided by AgilePoll.Com, a DBA of Moss Bay Solutions, LLC ("the Company," "we," "us," or "our"), you agree to these Terms of Service ("Terms"). If you do not agree, please do not use our Services.

Description of Services

Our Services include self-assessments, toolkits, and resources to help you tackle organizational and individual challenges. All Services are provided "as is," with no guarantees of availability, performance, or accuracy.

User Responsibilities

You agree to:

• Provide accurate, current, and complete information when creating an account.
• Keep your login credentials confidential.
• Use the Services only for lawful purposes and in accordance with these Terms.

Prohibited Activities

You may not:

• Engage in illegal activities, such as fraud or hacking.
• Misuse the Services (e.g., harassment, impersonation, or unauthorized data access).
• Interfere with the Services (e.g., uploading viruses or overloading servers).
• Use the Services for commercial purposes without our permission.
• Use automated methods (bots, scrapers, or data mining tools) to access, extract, or index our content or user data.
• Systematically retrieve data or content to create collections or directories.
• Circumvent or disable security features of the Services.
• Access non-public areas or bypass technical protection measures.
• Remove copyright or proprietary rights notices from content.
• Impersonate another user or sell/transfer your account.

Violation of these prohibitions may result in account termination, denial of refunds, and legal action.

Payment Interfaces

We accept Visa, Mastercard, American Express, and Discover. We may adjust prices and will notify subscribers of changes 30 days in advance. You authorize us to charge your payment method.

Refund Policy

We offer refunds within 14 days of purchase, subject to normal usage and adherence to these Terms. Excessive usage or violations void refund eligibility. For refunds, contact support@agilepoll.com.

Content Protection and Intellectual Property

All content provided is owned by the Company and protected by intellectual property laws. Use is limited to personal, non-commercial purposes as stated in these Terms.

Limitation of Liability

Our Services are provided "as is" without warranties. We are not liable for downtime, data loss, damages from use, or indirect damages. Total liability is limited to the amount paid, not exceeding $500.

Termination

We may suspend or terminate your account without notice for violating these Terms or other reasons.

Governing Law and Dispute Resolution

These Terms are governed by Washington State law, with disputes resolved through arbitration in King County, Washington.

Changes to These Terms

We may update these Terms periodically. Continued use after updates signifies acceptance.
